Terms of sale
These terms govern the purchase of the ordering system from ENS Software. Read them before you pay; completing payment means you accept them.

1Parties and scope
- The seller is ENS Software, and the buyer is the owner of the business the purchase is made for.
- The subject of the contract is a ready-made ordering system reconfigured in the buyer’s identity and delivered on three platforms: web, iOS and Android.
- The offer is available to food businesses internationally. Any specific jurisdiction or activity is agreed in writing.
- This page and the contract signed between the parties are the reference. Any verbal promise outside them is not binding.
2What the price includes
- The complete system: menu, sections, items and options, branches, orders and the operations board.
- Rebranding across every front end: the restaurant name, logo and primary and accent colours.
- Publishing the ordering site on a domain owned by the buyer.
- Preparing an iOS app and an Android app under the restaurant name and submitting them to the App Store and Google Play.
- Loading the first menu with the data the buyer sends in an agreed format.
3What the price does not include
- Hosting and monthly running costs. Quoted separately on request.
- Ongoing technical support after delivery. Quoted separately on request.
- Custom changes and development specific to the buyer beyond the agreed scope.
- Apple and Google developer account fees, domain fees, and payment gateway fees.
- Content production: photographing items, writing descriptions, or designing a new logo.
4Price and payment
- The price is a one-time $1,500, paid in US dollars via Skrill.
- Payment is processed by Skrill. We do not receive or store card details on our servers.
- There is no monthly subscription, and ENS takes no share or commission of the restaurant’s customer orders.
- Payment is treated as confirmed when Skrill confirms the transaction to us on the server, not when a browser reports success.
- The published price applies to the offer live at the time of payment, with no retroactive effect on prior purchases.
5Timeline and delivery
- The setup period is two weeks: one week for setup and rebranding, and one week for publishing and submitting both apps.
- The count starts only after both conditions are met together: confirmed payment and a signed contract.
- The count pauses during any period we are waiting on information, a file or an approval from the buyer.
- Delivery is complete when the site is published, both apps are submitted to the stores, and the operations board access is handed over.
- App Store and Google Play review times are outside ENS’s control and are not counted within the two weeks.
6Buyer obligations
- Provide the restaurant name, logo and two colours in a usable format.
- Own or purchase the domain the site will be published on, and authorise us to configure its records.
- Open Apple and Google developer accounts under the business name, or authorise us to do so in writing.
- Open a merchant account with a payment gateway under the business name to receive customer payments.
- Warrant that the logo, images and names sent are owned or licensed by the buyer, and bear responsibility for any dispute over them.
- The accuracy of the menu and prices sent. ENS transfers them as provided and does not review their commercial accuracy.
7Ownership and licence
- The system’s source code and core components remain owned by ENS.
- The buyer receives a perpetual, non-exclusive licence to use the delivered copy to run their business.
- The restaurant’s data, its customers’ data, its menu and its content belong to the buyer alone.
- The buyer may not resell, sub-licence or hand the system to a third party as a standalone product.
- ENS may reference the project name in its portfolio unless the buyer objects in writing.
8App stores
- Both apps are published under the buyer’s own developer accounts and carry the restaurant name.
- We prepare the files, metadata and responses to review notes.
- The final accept or reject decision rests with Apple and Google, and ENS guarantees neither the review time nor its outcome.
- If a store requires a technical change we make it at no extra fee. A change arising from the nature of the buyer’s business or content is handled under a separate agreement.
9Restaurant customer payments
- Online payment for the restaurant’s customers is connected to the restaurant’s own merchant account, not ENS’s.
- Customer money never passes through ENS at any stage, and we bear no responsibility for payment disputes between the restaurant and its customers.
- The demo does not show customer online payment, and that is intentional.
10Limitation of liability
- The system is delivered as described on this page and in the live demo available before purchase.
- ENS is not liable for lost profits or indirect damages arising from use of the system or its downtime.
- ENS’s maximum financial liability to the buyer does not exceed the amount actually paid for this offer.
- Liability does not cover failures caused by hosting, the domain, the payment gateway, the app stores, or the buyer’s modification of the system.
11Termination
- Either party may terminate before the contract is signed in line with the refund policy.
- ENS may pause work if the information required from the buyer cannot be obtained for more than thirty days, to resume when it becomes available.
- ENS may terminate if the system is used in an activity that is unlawful in the applicable jurisdiction.
12Governing law and jurisdiction
- Governing law and jurisdiction are stated in the signed contract and are pending legal review for cross-border sales.
- The parties will seek to resolve any dispute amicably within thirty days before resorting to formal proceedings.
13Updating these terms
- We may update this page for future offers.
- The version applying to any purchase is the one published at the time payment is completed, kept attached to the contract.
